Terms of Use

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only if a parent or legal guardian has reviewed these Terms and the Privacy Policy and agrees to them on your behalf. By using the Service, you represent that you meet these requirements.

• You can sign in with a Google account or with an email address and password.
• You agree to provide accurate information and to verify your email address if asked.
• You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you believe your account has been accessed without permission.
• Do not share, sell, or transfer your account to anyone else.

APex generates study materials — such as review outlines, study plans, practice questions, feedback on your answers, flashcards, and tutoring chat responses — using artificial intelligence provided by third parties. It is an educational aid meant to supplement, not replace, your course, your teacher, and official exam materials.

The tutor chat, practice feedback, and all other generated content come from an AI system, not a human tutor, teacher, or counselor.

AI output can be inaccurate, incomplete, out of date, or inconsistent with the current exam format. You are responsible for checking anything important against official College Board materials and your teacher. We do not guarantee any particular exam score, grade, or outcome.

Content generated for common requests — for example, review outlines, study plans, flashcard decks, and concept explanations — may be saved and shown to other users who make the same request. Your practice questions, answer feedback, and chat conversations are generated for you individually, but can still contain errors.

You agree not to:

• use the Service in violation of any law or anyone's rights;
• try to access another person's account, or any part of the Service you are not authorized to access;
• interfere with, overload, or disrupt the Service, or bypass or attempt to bypass its security measures or usage limits;
• use bots, scrapers, or other automated means to access the Service, or call the Service's back-end endpoints other than through the app as provided;
• reverse engineer or copy the Service, except where the law expressly allows it;
• submit content that is unlawful, harassing, hateful, or infringing, or use the Service to generate such content;
• submit sensitive personal information about yourself or others.

You keep ownership of what you submit, such as chat messages, answers, and topics you type. You give us a limited license to use that content only as needed to operate the Service — including sending it to our AI provider to generate a response, and saving the topic or request together with the generated result so it can be reused for other users. Because of that, please do not put personal information in topic or search fields.

You may use the AI-generated output for your own personal, non-commercial study.

The Service, including its software, design, and branding, belongs to JDN Sixty Four LLC and its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

The Service relies on third parties, such as providers of hosting, authentication, database, AI, and Google sign-in. Their own terms and privacy policies apply to their services, and we are not responsible for their acts, outages, or content.

We may add, change, suspend, or remove features at any time, and we may apply or change usage limits. We do not promise the Service will always be available or free of errors, and we are not obligated to keep any data you have saved.

You can stop using the Service at any time. We may suspend or end your access if you violate these Terms, if your use creates risk or harm for us or others, or if we discontinue the Service. Sections that by their nature should survive termination will survive, including the disclaimers, limits on liability, and governing law.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE OR ANY AI-GENERATED CONTENT WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, JDN SIXTY FOUR LLC AND ITS MEMBERS, MANAGERS, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GRADES, OR EXAM RESULTS, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.

Some places do not allow certain limits on liability, so parts of this section may not apply to you.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Palm Beach County, Florida, and you and we consent to the jurisdiction of those courts.

We may update these Terms from time to time. We will post the updated Terms with a new effective date, and for material changes we will ask you to accept the updated Terms before you continue using the Service.

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
